Appeals Court Tosses Foreclosure Suit Against Wells Fargo
A federal appeals court affirmed the dismissal of a Fair Housing Act lawsuit by Miami Gardens, Fla., charging Wells Fargo with mortgage discrimination that led to local foreclosures.
The 11th U.S. Circuit Court of Appeals ruled that the city did not provide enough evidence to prove it had standing to pursue the suit.
ICBA participated in a joint friend-of-the-court brief when the suit reached the Supreme Court in 2017. The high court sent the case back to the lower court, ruling that the city must show direct harm.
