ICBA and other groups asked Congress to strike a provision in the recently passed GENIUS Act that grants an uninsured state-chartered bank with a payment stablecoin subsidiary broad authority to engage in nationwide money transmission and custody activities, bypassing host state licensing and oversight. ICBA and the other groups said Congress should strike the provision in market structure legislation now under consideration in the Senate and reject any proposals that would extend preemption to the activities of other uninsured banks.
