In a comment letter to the FDIC, ICBA said it preferred an FFIEC appeals office but supported the proposed enhancements to the FDIC’s supervisory appeals process. ICBA urged the FDIC to require reviewing officials to have significant community banking experience, clarify the burden of proof by applying a preponderance of the evidence standard, and publish informational materials explaining the supervisory appeals process.
