ICBA Advocates Uniformity, Certainty in FCC Rules

Last week, ICBA and other financial services trade associations filed an amicus brief with the Supreme Court, advocating for uniformity and certainty in hearing challenges to FCC rules. In PDR Network, LLC, et al. v Carlton & Harris Chiropractic, Inc., the Supreme Court will hear arguments concerning whether the Hobbs Act prohibits federal district courts from hearing challenges on FCC rules, in this case, the Telephone Consumer Protection Act. The brief argues that the Hobbs Act prescribes a streamlined process for challenging FCC orders, and that challenges outside that process introduce uncertainty into compliance with FCC rules.
